The US Department of Labor has obtained $170K in wages and damages following an investigation that revealed a Bakersfield construction company had failed to pay overtime to 74 workers.

Investigation Findings:
The U.S. Department of Labor’s Wage and Hour Division conducted an investigation and found that Universal Welding and Construction Inc. failed to pay 74 workers overtime rates for the hours they worked beyond 40 in a workweek. This violation of the Fair Labor Standards Act resulted in workers being denied their full earnings.

Back Wages Recovered:
As a result of the investigation, the following amounts were recovered for the affected employees:
– $85,004 in unpaid overtime wages for 74 employees
– $85,004 in liquidated damages for 74 employees
– $34,954 in civil money penalties

According to Wage and Hour Division District Director Cesar Avila in Sacramento, “Employers have a responsibility to pay their workers all the wages they have earned, including overtime. We encourage employers to seek compliance assistance and utilize our online educational tools to avoid violations like those found in this case.”

Under the Fair Labor Standards Act, most employees in the U.S. are entitled to receive at least the federal minimum wage for all hours worked and overtime pay at a rate of one and a half times their regular pay for any hours worked over 40 in a workweek.
