The US Department of Labor has retrieved $167,000 in unpaid overtime compensation and damages on behalf of 17 employees who were not properly paid by a restaurant in West Virginia.

Investigation Findings:
During an investigation conducted by the U.S. Department of Labor’s Wage and Hour Division, it was discovered that Ole Jose Grill & Cantina LLC, operating as Ole, Jose Grill & Cantina, had violated the Fair Labor Standards Act. The violations involved the improper payment of tipped employees, misclassification of one employee as an independent contractor, and failure to pay overtime premiums and keep accurate records for kitchen staff.

Back Wages Recovered:
As a result of the investigation, a total of $83,632 was recovered in back wages for 17 employees.

Liquidated Damages Paid:
In addition to the back wages, Ole Jose Grill & Cantina LLC also paid $83,632 in liquidated damages.
